Over several years, earned millions yet failed to fulfill repayment obligations for an extended period
News Report (Reporter Zhang Xiaojing, Correspondent Zheng Shanshan): Over five years, earning several million yuan but refusing to repay 800,000 yuan in debt. Recently, the People’s Court of Yuyao City, Zhejiang Province, concluded a case of willful non-enforcement of a judgment. The defendant, Yang, was sentenced to ten months in prison with a one-year probation.
In March 2015, the Yuyao Court legally ordered Yang to repay Chen 800,000 yuan borrowed. After the judgment took effect, Yang did not fulfill his repayment obligation. After the case entered enforcement proceedings, the court served him with enforcement notices, property declaration orders, and consumption restrictions. However, Yang appeared cooperative on the surface, promising to comply within a deadline, but in reality, he delayed enforcement through tactics like not answering calls and not repaying.
In March 2017, Yang reached an enforcement settlement with Chen, agreeing to repay in installments. However, after paying the initial 50,000 yuan, Yang failed to continue fulfilling the settlement agreement. During an enforcement reception, the enforcement judge found that Yang’s clothing and demeanor did not match his claim of having no income source. The court immediately conducted dynamic checks on his accounts. Investigations revealed that during enforcement, multiple accounts under Yang’s name had frequent transactions. From January 2019 to February 2024, his accounts had a total income of over 9.5 million yuan. Yet, Yang did not report these assets to the court or repay the debt, instead using the funds for travel, entertainment, and other expenses. The court then transferred this information to public security authorities for investigation.
In August 2024, Yang voluntarily surrendered to the police and fully paid the enforcement amount. After trial, the court held that Yang, capable of complying with the court’s effective judgment, deliberately refused to do so, which constituted a serious offense of refusing to enforce judgments or rulings. Considering his criminal facts, nature, remorse, and social harm, the court issued the above judgment. The judgment has now taken legal effect.
Judge’s Reminder
Enforcement is the “last mile” in achieving fairness and justice, and a key link in ensuring judicial authority and credibility. Fulfilling obligations specified in legally effective documents is the responsibility of every citizen. In this case, Yang, with substantial disposable income, refused to repay his debt, which not only severely infringed on the legal rights of the creditor but also openly challenged judicial authority.
Judges remind everyone that integrity is the foundation of personal conduct and business. Please value your personal credit, proactively fulfill legal obligations, and do not indulge in complacency or test the law. Any attempt to evade enforcement, hide assets, or resist enforcement will be strictly prosecuted under the law.
