Crypto Reporter: US Judge Shows More Sympathy Towards Uniswap Developers, "Neutral Infrastructure" Could Be a Key Criterion
Deep Tide TechFlow News: On March 10th, crypto journalist Eleanor Terrett posted on X platform that reviewing the trial of Tornado Cash co-founder Roman Storm, she found that Judge Failla used a driving analogy in a lawsuit involving user Nessa Risle against Uniswap. The judge seemed to show more sympathy toward the developers behind Uniswap and was stricter with Tornado Cash’s developers.
According to materials forwarded by Eleanor Terrett, the judge’s view is that holding software developers responsible for strangers abusing neutral infrastructure would be illogical. The judge considers Uniswap as “neutral infrastructure,” while Tornado Cash is seen as “participating in illegal financial activities” (continuing operations despite knowing it was used for money laundering). This statement indicates that in future cases involving the liability of decentralized finance (DeFi) infrastructure, U.S. courts may consider whether developers merely provide neutral tools rather than actively participating in illegal activities.
