## Richard Heart's Legal Battle Against the SEC: A Costly Victory?

Richard Heart, the controversial creator of HEX, has achieved a turning point in his prolonged confrontation with U.S. regulators. In late April, the SEC announced it would neither appeal nor file a new fraud case against the former child actor turned cryptocurrency evangelist. This development came after charges were dismissed by a federal court in February.

The core of the judicial decision hinged on jurisdiction, not innocence. Judge Carol Bagley Amon determined that, since Richard Heart does not reside in the United States and his publications about HEX targeted a global audience, the SEC lacked territorial authority to prosecute the case. "The alleged misappropriations occurred through digital wallets and crypto asset platforms without verified connection to U.S. territory," the magistrate stated.

### The Price of "Regulatory Clarity"

Heart has posted on social media that this ruling represents an unprecedented victory for the cryptocurrency industry: "Richard Heart, PulseChain, PulseX, and HEX have achieved a regulatory clarity that almost no other project possesses." However, the market's reality tells a different story. The HEX token experienced a brief rally after the ruling but has remained virtually stagnant since the start of the legal issues. With a current price of $0.002253 and daily volumes barely reaching $250,000, the project shows signs of widespread disinterest among investors.

Industry analysts have pointed out that HEX has always exhibited characteristics typical of speculative schemes: promises of annual returns of 38%, incentives for recruiting new users, and the fact that Heart controlled approximately 90% of the token supply. Although he maintains an active following on social media, the project has lost significant relevance.

### Pending Issues in Europe

Although HEX has cleared the SEC scrutiny, Richard Heart faces much more serious legal challenges on European soil. Finnish authorities consider him a fugitive for two separate crimes: serious tax evasion and physical assault against a minor.

In September 2024, Finnish media reported that investigators detected a substantial discrepancy between the income declared by Heart and the estimates from the Finnish Tax Administration. Helsinki detective Harri Saaristol stated that "the extraordinary amount of money and the prolonged and deliberate nature of the activity generate well-founded suspicions of serious tax evasion." As a result, police confiscated millions of euros worth of luxury watches from a residence in Espoo, near Helsinki.

Additionally, Europol has activated international search warrants against Heart, listing him as a fugitive for "physical assault on a minor victim. The suspect grabbed her by the hair, dragged her to the landing, and knocked her to the ground." These charges have led to his inclusion on Europol and Interpol's most wanted lists.

Richard Heart's defense strategy was based on a procedural technicality: lack of U.S. jurisdiction. This suggests that the SEC's defeat was not due to a lack of evidence but rather territorial limitations.
